Terms of Service

1. Acceptance of Terms

By accessing devforgehq.dev (the “Site”) or engaging DevForge (“we,” “us,” or “our”) for services, including the AI Receptionist product, you agree to these Terms of Service. If you do not agree, please do not use the Site or our services.

2. Description of Services

DevForge provides custom software development services (AI agents and automation, full-stack web applications, mobile applications, and custom software) and operates the DevForge AI Receptionist, a subscription product that answers calls, handles frequently asked questions, and books appointments on behalf of subscribing businesses.

3. Discovery Calls and Proposals

Booking a discovery call through Calendly does not create a binding agreement for services. Custom development engagements begin only after both parties agree to a written proposal covering scope, timeline, and price.

4. AI Receptionist Subscription Terms

• The AI Receptionist is offered on the Starter, Growth, and Pro monthly plans described on the Site.
• Plans are billed monthly and renew automatically until cancelled.
• There is no long-term contract. You may cancel at any time with 30 days’ notice.
• Plan pricing covers all calls within normal operating volume for that plan; unusual or abusive call volume may be subject to a separate discussion.

5. Payment Terms

Subscription fees are due in accordance with the billing cycle agreed at signup. Failure to pay may result in suspension of the AI Receptionist service until payment is resolved.

6. Intellectual Property

For custom development engagements, ownership of deliverables transfers to the client upon full payment, unless otherwise agreed in writing in the project proposal. DevForge retains ownership of its own pre-existing tools, frameworks, and the underlying AI Receptionist platform.

7. Acceptable Use

You agree not to use DevForge services to violate applicable law, infringe on the rights of others, or interfere with the operation of the Site or the AI Receptionist platform.

8. Disclaimer of Warranties

Services and the AI Receptionist product are provided “as is” and “as available.” While we work to keep the AI Receptionist accurate and available, we do not guarantee it will be error-free or uninterrupted, and it should not be relied upon as the sole channel for urgent or emergency communications.

9. Limitation of Liability

To the maximum extent permitted by law, DevForge is not liable for indirect, incidental, or consequential damages arising from use of the Site or our services. Our total liability for any claim is limited to the amount paid by you for the service giving rise to the claim in the preceding three months.

10. Indemnification

You agree to indemnify DevForge against claims arising from your misuse of the Site or services, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles, unless a signed client agreement specifies otherwise.

12. Changes to These Terms

We may revise these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Site or services after changes take effect constitutes acceptance of the revised Terms.
